1. Agreement

By using designintelstudio.com (the "Site"), you agree to these Terms of Service. If you do not agree, please do not use the Site. The Site is operated by Design Intelligence LLC ("Design Intelligence," "we," "us"), Fort Smith, Arkansas. Your use of the Site is also governed by our Privacy Policy, posted on this Site. The Site is intended for users 18 or older.

2. What We Do

Design Intelligence provides architectural design services, publishes books and written works, and develops software applications and digital products. The Site describes these offerings and lets you contact us about them.

3. Not Professional Advice; No Architect-Client Relationship

Content on this Site — including project examples, blog posts, guides, and renderings — is general information only. It is not architectural, engineering, or construction advice for your specific project, and viewing it or contacting us does not create an architect-client or other professional relationship. Architectural services are provided only under a separate written agreement signed by both parties. Do not rely on Site content for design, code-compliance, or construction decisions without engaging a licensed professional for your specific project and jurisdiction. Nothing on this Site is an offer to provide architectural services in any jurisdiction where Design Intelligence or its personnel are not licensed to practice; architectural services are offered only where properly licensed. No professional service is rendered through the Site or its software, and no professional relationship arises from your use of them.

4. Use of the Site

You may use the Site for lawful, informational purposes. You may not copy, scrape, republish, or use automated tools to extract Site content, interfere with the Site's operation, or use it to infringe others' rights. We may suspend or terminate access to the Site at any time for violation of these Terms.

5. Intellectual Property

All Site content — including architectural designs, drawings, renderings, photographs, text, graphics, books and excerpts, software, and the Design Intelligence name and logo — is owned by Design Intelligence or its licensors and protected by copyright, trademark, and other laws. You receive a limited, revocable license to view the Site. No other rights are granted without our written permission. Architectural works are additionally protected under the Architectural Works Copyright Protection Act. Without limiting the foregoing, no license is granted to use any design, drawing, plan, or rendering on this Site to construct, or to prepare construction documents or derivative designs for, any building or structure.

6. Books and Publications

Books and written works are for your personal use. Purchases made through third-party platforms (such as booksellers) are governed by those platforms' terms in addition to these Terms. You may not reproduce or distribute our written works beyond what copyright law permits.

7. Software and Applications

Software or applications we provide are licensed, not sold, for your personal or internal use. You may not reverse engineer, resell, or redistribute them except where the law expressly permits. Software obtained through third-party platforms (such as app stores) is also subject to those platforms' terms. Specific products may carry their own license terms, which control if they conflict with these Terms. We may update, modify, or discontinue software at any time and do not guarantee uninterrupted availability. Output generated by our software is provided for general informational purposes only and is not architectural, engineering, or construction advice; verify all output with a licensed professional for your specific project and jurisdiction. Where any product we offer provides its own license or terms, those govern that product and control over these Terms as to that product.

8. Your Submissions

Information you send us (such as project inquiries) must be accurate and yours to share. You grant us permission to use it to respond to you and provide our services. Submissions are not confidential: sending us an inquiry, idea, or materials does not create a confidential, fiduciary, or professional relationship, and we have no obligation to review, respond to, or compensate you for unsolicited submissions. Do not send confidential or proprietary information before we have signed a written agreement.

9. Disclaimers

The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the Site will be error-free or uninterrupted. Links to third-party sites are provided for convenience and are not endorsements; we are not responsible for their content.

10. Limitation of Liability

To the maximum extent permitted by law, Design Intelligence will not be liable for indirect, incidental, special, or consequential damages arising from your use of the Site or its content. Our total liability for any claim relating to the Site will not exceed one hundred dollars ($100). This limitation does not apply to services provided under a separate written agreement, which are governed by their own terms. Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify Design Intelligence against claims arising from your misuse of the Site or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Arkansas. Any dispute relating to the Site will be resolved in the state or federal courts located in Sebastian County, Arkansas, except where applicable consumer law requires otherwise.

13. Changes; General

We may update these Terms from time to time. The current version, with its effective date, will always be posted on this page; for material changes we will update the effective date and, where practicable, provide notice on the Site. If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms are the entire agreement between you and us regarding the Site.
